Terms & Conditions
These Terms and Conditions apply to all transactions conducted via the eir evo marketplace, a brand of eir evo. By placing an order or engaging in any transaction on this website, you agree to be bound by these Terms and Conditions.
1. Definitions
- Customer:
- Refers to an individual acting on behalf of a business or organisation.
- eir evo marketplace:
- Refers to the eir evo marketplace brand and company, also referred to as “we”, “us”, or “our” throughout these Terms and Conditions.
- Goods:
- Any individual product, including software, as described on our website.
- Services:
- Any service or support provided by eir evo marketplace to the Customer.
- Order:
- A request placed by the Customer for Goods or Services in accordance with these Terms.
- Normal Working Days:
- Defined as 9:00 AM to 5:00 PM, Monday to Friday, excluding Bank Holidays and other public holidays.
2. Quotations
Quotations issued by eir evo marketplace are considered an invitation to treat and serve as a basis for negotiation only. All quoted prices and delivery dates are valid for three Normal Working Days from the date of issue. However, pricing may be subject to change within three days of the quotation being provided, depending on market conditions or supplier updates.
3. Orders
Orders placed via this website are not considered accepted until formally confirmed by eir evo marketplace. Verbal or written expressions of intent to order do not constitute acceptance until processed through the appropriate channels. eir evo marketplace reserves the right to decline any order at its discretion.
4. Payment
Customers with a credit account are required to settle their invoices within 30 days from the end of the month in which the invoice is issued.
Purchases may be made via credit card through the eir evo marketplace website. By placing an order with eir evo marketplace, the Customer confirms that a valid credit or debit card will be used for the transaction. The Customer also affirms that sufficient funds or credit facilities are available and that authorisation has been granted to complete the purchase. eir evo marketplace reserves the right to validate card details prior to supplying any Goods or Services.
Credit notes issued by eir evo marketplace must be used within 12 months from the date of issue. eir evo marketplace reserves the right to cancel any unused credit note after this period, and no reimbursement will be provided. If a credit balance remains unused beyond 12 months, eir evo marketplace retains the right to cancel the credit.5. Prices
All prices quoted are in Euro (€) and are exclusive of VAT, delivery, and installation. Goods and Services, along with applicable VAT, will be invoiced at the price displayed on the website at the time the order is placed.
Please note that eir evo marketplace reserves the right to adjust pricing at any time, including within three days of issuing a quotation, to reflect changes in market conditions or supplier costs.
6. Promotions/Special Offers
Promotional items or special offers advertised on the eir evo marketplace must be in stock at the time the order is placed. eir evo marketplace reserves the right to withdraw any promotion or special offer at any time without prior notice.
Promotional pricing displayed on the website is not applicable to customers with special pricing agreements, unless explicitly authorised by eir evo marketplace.
Please note that pricing is subject to change at any time, including within three days of issuing a quotation.
7. Delivery and Damage
eir evo marketplace offers free delivery on orders with a minimum value of €100. For orders below this threshold, a delivery charge of €8 will apply.
Goods and Services will be delivered via appropriate transport channels on the agreed delivery date. While we strive to meet all delivery timelines, eir evo marketplace is not liable for delays caused by circumstances beyond our reasonable control. In the event of a delay, we will notify the Customer as soon as possible.
Upon delivery, the Customer is required to sign for the Goods and Services to confirm receipt and verify that the order is complete. Once signed, eir evo marketplace cannot accept liability for any discrepancies in the order.
If any goods are damaged during transit, the Customer must report the issue within 24 hours of delivery. Failure to do so will result in eir evo marketplace being unable to accept liability for the damage.
If the Customer fails to accept delivery, eir evo marketplace reserves the right to:
- Redeliver the Goods and Services at the Customer’s expense
- Store and insure the Goods and Services at the Customer’s expense and risk
- Resell the Goods and Services, deducting any storage or insurance costs before refunding the remaining balance to the Customer
- Returned within 5 days of delivery
- Unopened, unused, and in perfect re-saleable condition
- Customer bears all return shipping costs
- Clearly display the RMA number on the outside of the packaging
- Be securely packaged with all manuals, accessories, and original packaging
- Ensure the manufacturer’s packaging is not defaced
- Be handled with reasonable care to avoid any reduction in value
- Opened items cannot be returned once the manufacturer seal is broken.
- Software that has been opened is non-returnable.
- CTO (Configure-To-Order) builds cannot be returned, as these are custom orders placed specifically for the customer. It is the customer’s responsibility to review and confirm that all specifications listed in the eir evo quote are correct before placing the order.
- Special order products may be non-cancellable and/or non-returnable, or may carry specific return restrictions provided at the time of sale.
- Loss of business or profits
- Damage to trading relationships
- Loss of goodwill
- Loss of data
- Any other financial loss not covered under the Warranties & Returns section
- Acts of God
- Explosions, floods, fires, or accidents
- Epidemics or pandemics
- Power failures
- Industrial disputes
- War or civil unrest
8. Cancellation, Warranties & Returns
Order Cancellation
Customers may cancel their order with eir evo marketplace prior to delivery by submitting a written request to the marketplace team at marketplace@eirevo.ie .
Faulty or Defective Goods
If goods or services received are found to be faulty or defective, a full refund will be issued in accordance with the manufacturer’s warranty and accompanying documentation.
Manufacturer’s Warranty
All goods supplied include a manufacturer’s warranty covering repair, return, or replacement of items that were operational upon receipt but later developed a fault. Warranty terms vary by manufacturer—please refer to the product documentation and contact the manufacturer or their authorised agent for support.
Unwanted Goods
Acceptance of returns for unwanted goods is at the sole discretion of the eir evo marketplace. If approved, goods may be returned for customer credit under the following conditions:
A restocking fee of €50 or 15% of the item value, whichever is greater, applies to unwanted or incorrectly ordered goods.
Return Process
To initiate a return, customers must email marketplace@eirevo.ie within 5 days of delivery to request a Returned Merchandise Authorisation (RMA) number. Returns are processed exclusively via email.

9. Liability
eir evo marketplace shall not be held liable for any indirect or consequential loss or damage arising from transactions with its Customers. This includes, but is not limited to:
Liability is limited strictly to the value of the Goods or Services supplied. In cases where products are found to be faulty or defective, eir evo marketplace may refund part or all of the invoiced amount, subject to the terms outlined in the Warranties & Returns section..
10. Force Majeure
eir evo marketplace reserves the right to cancel or postpone the delivery of Goods and Services in the event of circumstances beyond our reasonable control. These may include, but are not limited to:
In such cases, eir evo marketplace will not be held liable for any resulting delays or failure to fulfil obligations.
11. Intellectual Property & Product Imagery
eir evo marketplace respects and acknowledges the intellectual property rights of all suppliers and manufacturers featured on our website. Please note that product images are provided for illustrative purposes only. The actual Goods or Services received may differ from the images shown in our catalogue or on the website, particularly in the case of generic or standardised products.
12. General Terms of Business
eir evo marketplace will make every effort to respond to customer queries submitted via phone, email, or post within 48 hours of receipt. For customer complaints, we aim to respond within three Normal Working Days and will keep the customer informed throughout the resolution process.
If any provision within these Terms and Conditions is deemed invalid, illegal, or unenforceable by a competent authority, this will not affect the validity of the remaining provisions.
Any variation to these Terms and Conditions must be agreed in writing by an authorised representative of eir evo marketplace.
In the event of a dispute between the Customer and eir evo marketplace, the Customer agrees to submit the matter to arbitration under the Arbitration Act 1996, as a legally binding alternative to court proceedings.
